Power of Attorney Refund Scheme

From 1 February 2018 all those eligible can apply for a partial refund on their power of attorney fees.

The refund scheme has been launched for those who have been overcharged for their power of attorney registration fees. Partial refunds are applicable if you were overcharged when registering for lasting powers of attorney and enduring powers of attorney in England or Wales between 1 April 2013 and 31 March 2017.

Who can claim a refund?

The following people can claim the refund:

  • the ‘donor’ - the person who made the power of attorney
  • an ‘attorney’ - appointed by the donor to make decisions on their behalf

Refunds will be paid to the donor and must be claimed by 31 January 2021.

How much will be paid?

Refunds depend on when the fee was paid - see table below:

You’ll also get 0.5% interest. If you paid a reduced fee (‘remission’) you will get half the refund.

How to make a claim

Online

To claim online you will need:

  • the donor’s UK bank account number and sort code
  • a copy of the lasting power of attorney (if you have it)

Claim by phone if:

  • the donor doesn’t have a UK bank account
  • you’re a court-appointed deputy
  • you have a trust organisation as the attorney
